Orientation outlined to improve law-making quality and perfect institutions

NDO – On behalf of the Politburo, Politburo member cum permanent member of the Party Central Committee's Secretariat Vo Van Thuong has just signed and promulgated Conclusion No.19-KL/TW, dated October 14, 2021, on the orientation of the law building programme for the 15th National Assembly.

The Politburo discussed and determined the conclusion during the meeting on October 1, 2021, after listening to the report of the National Assembly Party Committee regarding the scheme on the orientation of the law-making programme for the 15th NA as well as opinions from relevant agencies.

The Conclusion stated that over the past years, during the implementation of the Politburo's Resolution No.48-NQ/TW, dated May 24, 2005, on the Strategy for building and perfecting the Vietnamese legal system by 2010, with orientations to 2020, and the implementation of the 2013 Constitution, the country's legal system has been essentially complete, stable, and unified. However, it has not yet met the development requirements of the country in the new situation; some regulations remain inadequateand are hindering development.

Continuing to carry out the task of strengthening the construction and improvement of the socialist law-governed state under the leadership of the Party, the work of building laws and perfecting institutions must be carried out by agencies and organisations in the political system with a focus on constantly improving the quality, meeting the requirements of comprehensively promoting the renewal process, socio-economic development, ensuring national defence and security, and international integration for the nation’s rapid and sustainable development.

The goal of law-making work for the 15th NA is to synchronously complete the development institution and create a legal framework for the successful implementation of socio-economic development tasks in the 2021-2025 period in accordance with 12 national development orientations, 6 key tasks and 3 strategic breakthroughs set out by the 13th National Party Congress.

In the process of implementing the law-making programme for the 15th NA, it is important to note that the law formulation and promulgation must be cautious and well implemented at each stage, closely followingand promptly meeting the requirements of reality.

Great importance must be attached to perfecting the legal system in a complete, synchronous, uniform, time, feasible, stable, open, and transparent manner with international competitiveness; take the legitimate rightsand interests of people and businesses as the focus; strengthening supervision and control over the exercise of state power; promoting creative innovation; and, at the same time, tightening discipline and upholding responsibility, especially for the leaders in law-making, while fighting against negative acts during the law-making process.

In addition, it is necessary to innovate methods, improve operational efficiency of the NA, increase the initiative of NA bodies and deputies in the legislative work as well as the supervision of the law enforcement; ensure close coordination among agencies in the process of summarising, formulating policies, drafting, collecting opinions, absorbing, revising and passing laws; and increase the attraction of experts, scientists, and practitioners with experience, in-depth professional knowledge, fairness, objectivity, for the sake of the nation to participate in the formulation of laws.

Attention should also be paid to promoting the role of the people, the Vietnam Fatherland Front and its member organisations in improving the quality of social criticism work on the legislative process and supervising the law enforcement; consolidating and improving the quality of law-making staff; as well as devising appropriate mechanisms to secure and strengthen investment resources and renew the mechanism of allocation and effective use of funding for law building and enforcement.
