Secretariat disciplines provincial Party committee and Party members for violations

The Secretariat has decided to take disciplinary measures against the Vinh Phuc provincial Party Committee tenure 2010-2015 and its former Secretary Pham Van Vong, as well as Ngo Van Tuan, former Secretary of the Thanh Hoa provincial Party Committee.

The decision was made during a Secretariat meeting under the chair of Party General Secretary Nguyen Phu Trong in Hanoi on December 17 to discuss the disciplinary measures against the aforementioned.

Before adopting the disciplinary measures, the Secretariat considered proposals from the Party Central Committee’s Commission for Inspection on the proposed discipline against the Vinh Phuc Party Committee term 2010-2015 and Pham Van Vong, former Secretary of the Vinh Phuc Party Committee from 2010 to 2015 and former Chairman of the Vinh Phuc People’s Council from 2011 to 2016; in addition to the other proposed disciplinary actions against Ngo Van Tuan, member of the Thanh Hoa Party Committee, Vice Chairman of the Thanh Hoa People's Committee, former Thanh Hoa Party Secretary, and former Director of the Thanh Hoa Department of Construction.

The Secretariat stated that the Vinh Phuc Party Committee during the 2010-2015 term violated Regulation No. 51-QĐ/TW dated April 19, 2007 by the Secretariat on the tasks and working relations of the provincial and municipal Party Committees in advising the provincial Party Committee to issue working regulations, in which it stipulates the authorisation of the provincial Party Committee to consider and settle several socio-economic issues that go beyond its authority, thus limiting the role and responsibilities of the provincial Party Committee in leadership and direction.

The Committee also violated the principle of democratic centralism and the regulations of the Party and the State on the organisation and personnel work. It decided to appoint and introduce candidates who did not meet the standards and conditions as prescribed, while showing signs of giving favours to them. There is a lack of inspection and supervision so that several agencies and organisations have an irregular number of departments and deputy heads at department level, while using contractual labourers in contravention of regulations.

Vinh Phuc’s committee was also found to be violating in leading and directing the management and use of land and the investment management in the construction of a number of key projects. It violated the Working Regulations of the provincial Party Committee in giving approval to investment projects using land beyond its authority, while not making land allocation through auctions, causing losses to the State budget. It was also found lacking in terms of inspections, as they let the provincial People's Committee violate State management over key projects, causing serious consequences.

Vong, who was former Secretary of the Vinh Phuc Party Committee from 2010 to 2015, is responsible for the violations of the Committee under his leadership during that period. He violated the principle of democratic centralism, the working regulations of the provincial Party Committee and other regulations of the Party and State when making decision to appoint officials, which failed to ensure principles and meet standards.

Vong also presided over the Committee’s meetings to agree on several projects using land in contravention of regulations, while not undertaking adequate supervision over provincial People's Committees that led to its serious violation of the management of investment in the construction of a number of key projects and in the management and use of land.

The Secretariat found that the violations of the Vinh Phuc Party Committee for the term 2010-2015 and Pham Van Vong were serious, negatively affecting the prestige of the Party.

Pursuant to the Politburo’s Regulation No. 263-QĐ/TW and No. 102-QĐ/TW on disciplining Party organisations and Party members’ violations, the Secretariat decided to take disciplinary measures against the Party Committee of Vinh Phuc for the 2010-2015 period in the form of a warning, while the disciplinary measures against Pham Van Vong is in the form of his dismissal from the provincial Party Secretary position for the 2010-2015 term.

Ngo Van Tuan, former Secretary of the Thanh Hoa Party Committee has also been sanctioned for his violations.

Regarding to Ngo Van Tuan’s case, the Secretariat stated that from October 2010 to November 2015, as the Secretary of the Thanh Hoa provincial Party Committee and Director of the province’s Department of Construction, he violated the principle of democratic centralism and the regulations of the Party and State on personnel work.

He deliberately violated the regulations of the 2011 Civil Servant Recruitment Examination Council of Thanh Hoa province, while issuing a decision on the establishment of the Council for the Selection of Civil Servants of the Thanh Hoa Department of Construction, which was not in accordance with its authority, in order to give favour and support to the receiving, transferring and appointment of Tran Vu Quynh Anh, from a contractual employee to work as a civil servant. In a very short space of time, Anh was appointed as Deputy Head of Division then Head of Division and was proposed to the position of the Deputy Director of the Construction Department and joining the Party Committee of the Department, contrary to regulations.

Tuan was found to have issued decisions on the criteria for the appointment of staff that fall outside his competence and appointed multiple heads of departments and deputy heads of departments who were not qualified, in which the case of Tran Vu Quynh Anh is typical.

He also decided to establish a number of units under the Department of Construction, which is contrary to its competence and violates the regulations of the Party and the State on administrative reform and streamlining the organisational apparatus.

Tuan's offense is highly serious and systematic, leading to some Party organisations and Party members violating the laws and suffering discipline. During the review process, Tuan did not seriously acknowledge his violations. Based on the content, nature, degree of influence and consequences of the violations, the Secretariat decided to implement the disciplinary measure against Ngo Van Tuan in the form of removal of all his positions in the Party.
