1. The important finalised competence of the justice sector: the revised Law on Legal Aid takes the legitimate rights and interests of the beneficiaries at the centre; while the revised Law on State Compensation Responsibility has been expanded to enhance responsibility for the performance of public duties.
2. Bilateral cooperation in the legal and judicial field has grown to new heights with a marked breakthrough in relations with neighbouring countries.
In 2017, the judicial sector has actively enhanced the effectiveness of international law cooperation with practical bilateral cooperation activities with neighbouring countries, including Laos, Cambodia and China.
3. The law enforcement has witnessed positive changes: the documents detailing the implementation of laws and ordinances under the authority of the Government and the Prime Minister have been finished, while law dissemination and education recorded innovations.
With various resolute solutions, the work of building and issuing documents detailing laws and ordinances in 2017 achieved positive results. The absence of detailed documents guiding the implementation of the law has dropped to its lowest level in recent years. Law dissemination and education have been innovated in association with the enhancement of IT applications and successful organistion of law contests, dialogues and online sessions, attracting hundreds of thousands of participants.
4. Extracting and applying historical values of legal reform and building State apparatus in the current period.
In order to inherit the outstanding national governance experience in the history and glorious traditions of the nation, the Ministry of Justice has carried out research activities to clarify and disseminate valuable lessons learned on legal reforms, construction of the State apparatus and the use of talents under the reign of King Le Thanh Tong in the 15th century.
The ministry’s research results have been reported to the Prime Minister for widely disseminating to relevant ministries, committees, agencies and research and training institutions in order to further research and apply the task implementation on improving the legal system, administrative and judicial reforming, building the rule-of-law State and carrying out staff strategies in the current period.
5. The work of civil judgment execution has continued to make positive changes, achieving the highest results so far in terms of workload and money collected from execution.
Amidst the country's difficult socio-economic situation, plus the increased number of workload and money (up 5.57% of workload and 19.67% of money, equivalent to VND173 trillion) that need to be handled from civil cases, the sector has completed the highest amount so far, with the handling of over 19,000 units of workload and VND6trillion higher than 2016.
6. Implementing the national action plan on civil status registration and statistics for the 2017-2024 period and expanding the civil status registration and management information system with important results to timely service the people.
Vietnam's national action plan on civil status registration and statistics for the 2017-2024 period is an important roadmap with practical implications for ensuring the exercise of citizens' rights and directly affecting the management of the population and society, while in accordance with international practices.
So far, the sector’s civic registries have registered new birth records for nearly 2 million cases, re-issued birth records for more than 750,000 cases (up 38.3% compared to 2016) and carried out marriage registration for more than 700,000 couples.
7. Operating the software for online registration of transactions secured by movable assets with the highest level of online public services, contributing to administrative reform and creating favourable conditions for people and enterprises.
The Ministry of Justice has upgraded and put into operation its software for registering online transactions secured by movable assets up to Level 4 concerning online public services, contributing to significantly improving the Vietnam’s access to credit factor to the 29th out of 190 countries (according to the World Bank's Doing Business 2018 report).
8. The legal training establishments improve on the criteria and quality of training, contributing to the implementation of judicial reform in services of international integration.
In 2017, training institutes under the Ministry of Justice have made great efforts in fulfilling the set targets on training with increasing quality. Hanoi Law University has recruited and organised enrollment for about 3,000 full-time, more than 500 part-time, and over 500 post-graduate students. The Vietnam’s Judicial Academy enrolled over 4,000 students.
9. The codification of a legal document system goes beyond the schedule, meeting the demand for exploitation and use of people and enterprises.
The Ministry of Justice has actively coordinated with related ministries and agencies to complete codification for 67/265 items, aiming for an "early finish" of a codification structure compared to the roadmap that was approved by the Prime Minister. Although still at its early stage, the structure has been warmly received by people and businesses.
10. The judicial sector actively responds to the Government's message on "supporting startups businesses."
In 2017, the Ministry of Justice and relevant legal organisations have reviewed the difficulties and bottlenecks in enterprises’ production and business activities related to legal provisions on land, construction, housing, environment, investment, business and specialised inspection. It then proposed the Prime Minister to amend and supplement 16 laws in these fields.
The work of evaluating legal documents on investment, business and startup is a focus by the sector, ensuring that unnecessary administrative procedures and business conditions are removed, thus creating a favourable environment for enterprises to exercise their rights in doing business.
