The DOC's decision was made based on the timely withdrawal of the request for review from the petitioner Mid Continent Steel & Wire Inc.
Previously, the DOC published a notice of opportunity on July 3, 2017 to request an administrative review of the countervailing duty order concerning steel nails from Vietnam for the period from the beginning of January to the end of December 2016.
On July 31, 2017, the DOC received a timely request from the petitioner to conduct an administrative review of the countervailing duty order with respect to 14 Vietnamese steel companies.
Based on the request, on September 13, 2017, the department published a notice of initiation of administrative review for this countervailing duty order. However, on September 28, 2017, the petitioner timely withdrew its request for an administrative review for each of the 14 companies.
Accordingly, the DOC has terminated the administrative review of the countervailing duty order on steel nails imported from Vietnam covering the period of January 1, 2016 to December 31, 2016.
The DOC will also instruct US Customs and Border Protection to access countervailing duty on all appropriate entries at a rate equal to the cash deposit of the estimated countervailing duty required at the time of entry or withdrawal from warehouses for consumption during the aforementioned period.
