NA Standing Committee convenes 30th meeting

The 30th meeting of the National Assembly (NA) Standing Committee officially commenced in Hanoi on January 10, under the chair of NA Chairwoman Nguyen Thi Kim Ngan.

In her opening remarks, the senior legislator said that the NA Standing Committee will comment on issues with different opinions in the draft revised Law on Execution of Criminal Judgments; consider and appoint members of the National Council for the Selection and Supervision of Judges; consider and decide on the adjustment of the administrative boundaries of two communes in Hong Ngu district and the establishment of Thuong Thoi Tien townlet under Hong Ngu district, Dong Nai province; and discuss the merger of commune-level administrative units and the formation of six wards under Chi Linh town, and the establishment of Chi Linh city under Hai Duong province.

Later, lawmakers focused on debating some issues with different opinions in the draft revised Law on Execution of Criminal Judgments, including the organisation of employment locations outside prisons for inmates, the rights and obligations of inmates, the execution of criminal judgments toward commercial inmates, and the responsibility for managing, supervising and educating inmates who are conditionally released before schedule, and those with suspended and non-custodial sentences.

The NA deputies basically agreed with the draft law’s provisions allowing jails to establish working locations for inmates. They added that, in order to ensure feasibility and accordance with the law, the organisation of working locations outside prisons must satisfy the requirements on ensuring security and order at the work venues.

With regards to the rights and obligations of inmates, the NA Justice Committee realised that, in principle, the fundamental rights of human beings and citizenship have already been stipulated in the Constitution, so the expertised laws need to specifically concretise these rights. The concretisation of human rights for inmates in line with the Constitution is necessary but should be implemented with suitable steps in order to ensure feasibility and the State’s responsiveness.

Concerning the responsibility for managing, supervising and educating inmates who are conditionally released before schedule, and those with suspended and non-custodial sentences, NA Vice Chairman Uong Chu Luu said that it should be maintained as at present, which means the responsibility is assigned to the commune-level People’s Committee and public security forces.

He proposed that the relevant ministries and agencies learn more international practices and experience from other countries in order to provide further information for the NA and the NA Standing Committee for reference, so that the draft law will ensure synchronism with other laws once considered and approved at the upcoming 7th session of the NA.

Also this morning, the NA Standing Committee considered and reached a consensus on fielding Dao Viet Trung, Chairman of the President’s Office, to join the National Council for the Selection and Supervision of Judges, in replacement of Giang Son who retired from January 10, 2018.
