This decree regulates the export and import business of various types of paddy fields and rice (hereinafter referred to as “rice”) and activities involving temporary import for re-export, temporary export for re-import, transshipment, transit, and contract processing of rice for foreign parties. However, non-commercial exports, as well as the provision of rice as aid, gifts, or donations, fall outside the scope of this decree.
Under the regulations, Vietnamese traders from all economic sectors — provided they meet the prescribed conditions and are granted a Certificate of Eligibility for Rice Export Business (hereinafter referred to as the “Certificate”) — are entitled to engage in rice export business in accordance with this decree and other relevant legal provisions.
The decree stipulates that traders established and registered in accordance with the law may engage in rice export business if they possess at least one specialised warehouse for storing rice, and one rice milling facility that complies with legal regulations regarding food safety, standards, and technical regulations.
The Ministry of Industry and Trade issues the Certificate — in both paper and electronic formats (where applicable) — to traders who meet the prescribed conditions for rice export business.
The Ministry of Industry and Trade shall consider and decide on the revocation of the Certificate in the following cases: the holder requests revocation; the trader is dissolved or goes bankrupt in accordance with the law; the trader has their business registration certificate, enterprise registration certificate, or investment registration certificate revoked; the trader fails to act as the exporter on export declarations for a period of 12 consecutive months, except where the trader has notified the suspension of business operations as prescribed by law; the trader fails to maintain compliance with the aforementioned business conditions during operations; the trader makes false declarations regarding specialised rice storage facilities or rice milling facilities, or commits other acts of fraud to obtain the Certificate; the trader fails to implement, or improperly implements, directives or management decisions issued by competent authorities; the trader fails to submit a report within 45 days of the Ministry of Industry and Trade issuing a reminder regarding the mandatory reporting obligations for rice exporters; the trader fails to maintain the prescribed levels of paddy or rice reserves; or upon the proposal of a competent authority.
The aforementioned decree also specifies transitional provisions in this sector. Decree No. 365/2026/ND-CP is scheduled to take effect on October 1, 2026.
