Viet Nam fine-tunes aircraft registration regulations with IDERA adoption

Viet Nam has completed the consolidation and revision of regulations related to the registration of aircraft nationality, ownership, and operation, thereby ensuring consistency, transparency, and alignment with international civil aviation practices.

Specifically, a new decree, effective from November 2025, formally institutionalises the de-registration mechanism under the Irrevocable De-registration and Export Request Authorisation (IDERA), and promotes the use of electronic administrative procedures in aviation registration.

This decree provides a legal basis for the registration and de-registration of aircraft nationality, the registration and cancellation of rights over aircraft, the issuance of AEP codes, and the registration and de-registration of IDERA documents and authorisations designating individuals entitled to request aircraft de-registration or export.

The provisions apply to all agencies, organisations and individuals involved in aircraft registration activities in Viet Nam, except for state aircraft such as military, police, and customs aircraft (unless used for civil purposes).

A notable new feature is the detailed regulation of the de-registration mechanism under the IDERA document in conformity with the Cape Town Convention and Protocol, to which Viet Nam is a party.

Accordingly, only the person designated in the IDERA is authorised to request the de-registration of an aircraft’s nationality and its export.

When carrying out this procedure, the dossier must include written consent from parties holding higher-priority registered international interests, or documents proving that such interests have been settled.

The Civil Aviation Authority of Viet Nam will issue the certificate of de-registration of Viet Nam aircraft nationality and the export certificate of airworthiness within five working days of receiving a complete and valid dossier.

Applicants may submit dossiers in person, by post, or electronically.

An aircraft may be registered under Viet Nam’s nationality if it is owned or operated by a Vietnamese organisation or individual (including those permanently residing in the country) or leased under a dry-lease agreement of 24 months or more for operation in Viet Nam.

At the same time, the aircraft must not be registered under any other nationality; it must have completed de-registration procedures in any foreign country where it was previously registered.
