Digital transformation of asset and income control

In the first six months of 2024, the entire inspection sector has urged and inspected the implementation of 3,688 conclusions and decisions on inspection handling, of which 1,704 inspection conclusions have completed 100% of the required contents.

Thereby, 769.8 billion VND, 18 hectares of land have been recovered; 852 organizations, 3,326 individuals have been administratively handled; 327 cases, 70 subjects have been transferred to the investigation agency; 9 cases, 14 subjects have been prosecuted.

Although the results of recovering corrupt assets are higher year after year than the previous year, the risk of loss and difficulty in recovery is very high, especially in particularly serious corruption and economic cases.

According to the assessment of the Government Inspectorate, the recovery of corrupt assets is still a limitation of the work of preventing and combating corruption and negativity in our country today, and the main reason is that the amount of money to be recovered is very large, those who must execute the judgment have no assets or low-value collateral assets.

In addition, there are also institutional and mechanism problems in handling assets that affect the execution process; some cases still occur where the subject absconds, judicial assistance faces many difficulties...

Vietnam is gradually building a mechanism to promote non-cash transactions, especially limiting the use of cash in transactions and buying and selling of valuable assets to facilitate income control as well as tracing assets that have been dispersed; improving honesty and responsibility in declaring assets and income of cadres, civil servants and public employees and having strict handling of violations.

The competent authorities also regularly lead, direct the inspection, examination, supervision, and settlement of complaints and denunciations in the activities of preventing and combating corruption and negativity in general and the recovery of misappropriated and lost assets in criminal cases of corruption and economics in particular; promptly detect, rectify, and strictly handle violations related to the recovery of assets, valuation, and auction of assets in the execution of judgments; actively and proactively coordinate the seizure, freezing, and temporary detention of assets to serve the execution of judgments; and strengthen international cooperation to recover assets in criminal proceedings.

However, the important issue that can be clearly seen when handling cases and incidents is that during the settlement period, assets are often hidden, dispersed, legalized, or the legal status of the assets is unclear.

Therefore, to effectively recover corrupt assets, the Government Inspectorate needs to actively implement the project on building a national database on asset and income control approved by the Prime Minister in Decision No. 390/QD-TTg, dated March 28, 2022.

The successful implementation of the project will help competent authorities be more proactive in preventing, detecting and handling corruption, minimizing the loss of State money and assets as well as avoiding damage to the legitimate interests of organizations and individuals.
