Minister of Science and Technology Nguyen Manh Hung said that the draft law focuses on five key policy groups, including supporting the creation and commercial exploitation of intellectual property (IP) rights to promote innovation; simplifying administrative procedures to facilitate IP registration and rights establishment; enhancing the effectiveness of IP rights enforcement; ensuring full implementation of Vietnam’s international commitments on IP protection during the integration process; and updating new global developments in IP protection, in line with the nation’s policies and development level.
Notably, he noted that the bill introduces no new administrative procedures and ensures consistency with the Party’s and State’s guidelines on decentralisation, delegation of authority, science and technology advancement, digital transformation, innovation, as well as gender equality and ethnic policies. Presenting the verification report, Chairman of the NA’s Committee for Legal and Judicial Affairs Hoang Thanh Tung stated that the draft’s contents are consistent with the Party’s directions, ensure constitutionality, and largely maintain the consistency of Viet Nam's legal system while aligning with relevant international treaties to which Viet Nam is a member.
Tung said his committee basically agreed with the proposed policies on IP-based financing, while recommending that the drafting agency continue to review and refine the provisions to better protect the legitimate rights and interests of IP holders, meet the requirements of legislative innovation, and strengthen decentralisation, delegation of authority, and digital transformation in IP state management.
In addition, it proposed adding provisions specifying the responsibilities of intermediary enterprises in providing identifying information about entities violating IP rights, to create a stronger legal foundation for addressing infringements in this area.
