Revised Law on Legal Aid to be implemented nationwide from early 2027

The Prime Minister has issued Decision No. 920/QD-TTg promulgating a plan for the implementation of the Law amending and supplementing a number of articles of the Law on Legal Aid, aiming to ensure the law is enforced in a synchronised, consistent and effective manner nationwide from 1 January 2027.

One of the key tasks set out in the plan is the review, amendment and supplementation of legal normative documents relating to legal aid activities in order to align them with the new provisions of the Law. The Ministry of Justice has been assigned to take the lead in conducting reviews and amendments within its authority or proposing revisions to competent authorities for existing legal documents.

The ministry will also work with ministries, ministerial-level agencies, the Supreme People’s Court, the Supreme People’s Procuracy and relevant bodies to compile review results and prepare a report for submission to the Prime Minister. Provincial-level People’s Committees will be responsible for implementing this task at the local level. The work is scheduled for completion in the third and fourth quarters of 2026.

The Ministry of Justice has also been tasked with drafting and submitting to the Government a decree detailing a number of articles of the Law on Legal Aid and measures to ensure its implementation before 15 September 2026. In coordination with relevant agencies, the ministry will also prepare implementing circulars, including a joint circular to replace existing regulations on coordination in providing legal aid during legal proceedings. These documents are to be submitted before 31 October 2026.

According to the plan, the Ministry of Justice will organise conferences to disseminate the contents of the Law and provide implementation training for ministries, sectors, localities and relevant agencies through in-person, online or hybrid formats during the second, third and fourth quarters of 2026.

At the local level, provincial-level People’s Committees will organise dissemination and implementation activities for the Law and guiding documents for local agencies, units and commune-level authorities. At the same time, the Supreme People’s Court, the Supreme People’s Procuracy, the Ministry of Public Security and other relevant ministries and sectors will conduct training on the Law’s new provisions and coordination in legal aid activities for officials and civil servants under their management.

The Ministry of Justice will coordinate with the Ministry of Culture, Sports and Tourism, the Voice of Viet Nam, Viet Nam Television, the Viet Nam News Agency and mass media organisations to develop communication plans aimed at widely disseminating the new provisions to the public and relevant organisations.

During the third and fourth quarters of 2026 and in subsequent years, the Ministry of Justice will compile and publish materials serving communication and legal dissemination purposes. It will also coordinate with central and local agencies to organise communication activities through the press, digital platforms and other forms appropriate to different target groups. Agencies such as the Supreme People’s Court, the Supreme People’s Procuracy, the Ministry of Public Security, the Ministry of National Defence and related ministries and sectors will also organise conferences and communication products introducing the Law’s new points during the fourth quarter of 2026.

The Ministry of Justice will organise training and professional development programmes for legal aid providers every year. Provincial-level People’s Committees will be responsible for coordinating the implementation of these tasks locally.

In the fourth quarter of 2026, localities will conduct reviews and compile statistics on individuals eligible for legal aid, while also reviewing legal aid organisations and personnel to ensure that State legal aid centres truly become professional providers of essential public legal services at the local level. At the same time, local authorities will assess the need to establish branches of State legal aid centres and study measures to strengthen and expand the legal aid network in line with practical conditions, thereby facilitating timely and high-quality access to legal aid services for citizens.

According to the plan, from 2027 onwards, the Ministry of Justice will organise inspections on the implementation of the Law and guiding documents in order to promptly address difficulties, ensure the Law is effectively enforced in practice, improve the quality of public services and better protect the lawful rights and interests of legal aid beneficiaries.
