The plan aims to clearly define tasks, deadlines, implementation schedules and responsibilities of relevant agencies, organisations and units in carrying out Resolution No. 20/2026/QH16 dated April 23, 2026 on coordination mechanisms and special policies to improve the effectiveness of preventing and resolving international investment disputes, ensuring timely, consistent and effective implementation.
The Prime Minister has requested relevant ministries, sectors and localities to implement the following key tasks: from 2026 onwards, the Ministry of Justice will take the lead, in coordination with ministries, ministerial-level agencies, provincial-level People’s Committees and relevant agencies and organisations, in disseminating and promoting the Resolution and detailed implementation guidelines.
The Ministry of Justice will also work closely with the Ministry of Finance to prepare a draft Government decree detailing and guiding the implementation of Resolution No. 20/2026/QH16 on coordination mechanisms and special policies to improve the effectiveness of preventing and resolving international investment disputes, and submit it to the Government before June 30, 2026.
Under the plan, the Ministry of Justice will be responsible for drafting provisions on coordination mechanisms and special policies to enhance the effectiveness of resolving international investment disputes, specifically detailing and guiding the implementation of Articles 13, 14, 17 and 18 of the Resolution.
Meanwhile, the Ministry of Finance will be responsible for drafting regulations and related documents concerning: an investment registration mechanism to ensure effective and stable foreign investment attraction while minimising disputes under Clause 4, Article 7 of the Resolution; and a foreign investor response mechanism aimed at preventing international investment disputes under Clause 5, Article 9 of the Resolution. These documents are to be submitted to the Ministry of Justice before June 7, 2026 for consolidation and completion of the draft decree dossier.
The Ministry of Justice will also coordinate with ministries, ministerial-level agencies, provincial-level People’s Committees and related organisations to urgently draft a Government decree regulating the establishment, organisational structure and operational mechanism of the Centre for Prevention and Resolution of International Investment Disputes. The centre will operate as a public non-business unit providing essential public services related to the prevention and settlement of international investment disputes, in accordance with the task assigned under Clause 4, Article 19 of the Resolution. The draft decree is to be submitted to the Government before June 30, 2027.
Ministries, ministerial-level agencies, provincial-level People’s Committees and relevant organisations are required to review, formulate and issue within their authority, or submit to competent authorities for amendment, supplementation, replacement, abolition or promulgation, legal normative documents to ensure consistency with the Resolution and its detailed implementation guidelines, with completion required before March 1, 2027.
