Top leader urges revisions to land laws to maximise value of land resources

General Secretary and President To Lam has signed a resolution known as Resolution 21 of the 3rd Plenum of the 14th Party Central Committee on the guiding principles and direction for amending the Land Law and related legislation.

According to Resolution 21, it is necessary to strengthen land management, unlock and mobilise land resources, and safeguard the lawful rights and legitimate interests of the people, organisations, and businesses, while also ensuring national defence, security, and environmental protection, in order to help achieve the double-digit growth target and realise the country’s aspirations for rapid and sustainable development in the new era.

The resolution affirms that land is owned collectively by the entire people, with the state acting as the representative owner and exercising unified management.

The legal framework and policies governing land must be comprehensively improved in line with the development of a socialist-oriented market economy. Appropriate policies should be adopted for different categories of land users and forms of land use to maximise the potential and value of land resources.

In the overall objective, the resolution clearly states that land must truly become a strategic resource, a competitive advantage and a driving force for national development in the new stage.

Land resources must be managed, exploited and utilised as efficiently as possible, while ensuring social equity and stability, protecting the environment, and enhancing resilience to climate change.

The resolution sets the target that by 2030, the legal framework governing land will be fully harmonised, coherent, and consistent with the institutional framework of a socialist-oriented market economy, meeting the requirements of the country’s development.

To successfully achieve these objectives, the resolution outlines a series of tasks and solutions, including the prompt and comprehensive institutionalisation of the Party’s policies and guidelines on land management and use.

Priority will be given to amending and supplementing the Land Law and related legislation to ensure consistency, interoperability, and legal coherence.

It also calls for the restructuring of land administration agencies at both central and local levels to ensure a streamlined, stable, unified, effective, and efficient system, while further promoting decentralisation and the delegation of authority in exercising the state’s role as the representative owner of land on behalf of the people.

The resolution also calls for reforms and stronger inspection and oversight in the formulation, issuance, and implementation of land-related mechanisms and policies.

Party committees, Party organisations, and authorities at all levels, especially their leaders, are required to focus on directing and overseeing the formulation and enforcement of land policies and legislation.

If organisations or individuals under their authority violate legal provisions, seek illicit gains, cause losses to the state, or waste land resources, they will be held accountable in accordance with the law.
