Resolute efforts to prevent and repel smuggling and counterfeit goods

The government has just issued Resolution No. 397/NQ-CP on the governmental action plan for preventing and repelling smuggling, trade fraud, counterfeit goods, and intellectual property infringement until 2030.

The plan sets the goal that all cadres, public employees, and civil servants must uphold professional ethics and demonstrate high responsibility in performing their duties, ensuring competence, integrity, and resistance to manipulation. It also requires strict handling of officials who cover up or facilitate violations, under the principle of “no tolerance, no restricted zones, and no exceptions”; and absolutely prohibits the abuse of inspection activities in ways that disrupt the normal production and business operations of organisations and individuals. It also aims for 100% of agencies and units responsible for combating smuggling, trade fraud, counterfeit goods, and intellectual property infringement to be equipped with and apply science, technology, and modern equipment in management, monitoring, and controlling goods.

E-commerce platforms, social networks, press agencies, and television channels must not trade or advertise counterfeit goods, poor quality goods, goods with unclear origin, or goods infringing intellectual property rights. Organisations and individuals producing or trading goods related to consumer health are to be communicated and disseminated legal regulations on counterfeit goods and intellectual property. All consumers must receive communication and legal education on the protection of their rights.

The plan outlines eight key tasks and solutions, including: strengthening institutional perfection; perfecting organisational structures with sufficient capacity; and clearly defining functions, tasks, and powers for ministries, sectors, and two-level local governance. Mobilising the strength of the entire political system, and the strength of the people and businesses in combating smuggling, trade fraud, counterfeit goods, and intellectual property infringement. Building a contingent of cadres, public employees and civil servants with strong professional ethics and high responsibility in duty performance.

Enhancing inspection, examination, and supervision of agencies and organisations issuing permits and organisation of suitable assessments, ensuring accurate conclusions and results of state inspections on standards, technical regulations, and product quality, as well as strictly handling violations. Improving coordination among ministries, sectors, and localities, including two-tier local governance. Promoting the application of science, technology, and modern equipment in the management, monitoring, and control of goods; meeting requirements on finance, technique, technology, digital transformation, and databases for controlling goods on the market.

Strengthening communication to raise awareness of citizens and businesses of the dangers of smuggling, trade fraud, counterfeit goods, poor-quality goods, and goods infringing intellectual property rights. Promoting international cooperation in combating smuggling, trade fraud, counterfeit goods, and intellectual property infringement.
