Legal framework for Viet Nam-Cambodia waterway transport strengthened

The Ministry of Construction has issued Document No. 112/2026/VBHN-TT-BXD, providing guidance on implementing the agreement between the Governments of Viet Nam and Cambodia on waterway transport.

The document is expected to strengthen the legal framework, increase decentralisation to local authorities and simplify administrative procedures, facilitating the cross-border transport of goods and passengers between the two countries.

A key provision is the decentralisation of authority to issue cross-border transport permits for watercraft under local management. Provincial and centrally governed municipal Departments of Construction will be responsible for issuing the permits.

Applications can be submitted in person, by post or through the online public service system. Within one working day of receiving an incomplete application, the competent authority must provide guidance on completing it. Once all requirements are met, a cross-border transport permit must be issued within three working days. If a permit is refused, the authority must provide a written explanation.

For Cambodian vessels facing force majeure events such as natural disasters, accidents or damage that cannot be repaired promptly, the local Department of Construction where the incident occurs may grant a one-off extension of up to 30 days for the vessel to remain in Viet Nam. The request must be processed within one working day.

Permits are issued according to the type of operation, with those for multiple trips valid for up to 12 months and those for single trips or vessels carrying dangerous goods valid for up to 60 days.

The consolidated document also specifies permitted waterways, ports and landing stages for cross-border transport. Cambodian vessels operating in Viet Nam are prohibited from carrying domestic passengers or goods between two points within Viet Nam.

The regulations also set requirements for valid documents carried by vessels and crew members, covering vessel registration, technical safety and environmental protection, insurance, cargo or passenger declarations, and international travel documents.

The Viet Nam Maritime and Inland Waterways Administration is responsible for managing, guiding and inspecting cross-border waterway transport, while local Departments of Construction will coordinate implementation.

The new document standardises regulations on licensing, permitted routes, border procedures and safety requirements, helping facilitate safe and efficient waterway transport and promote trade and economic cooperation between Viet Nam and Cambodia.
